The Cost of Living (Tenant Protection) (Scotland) Act – Emergency legislation
The Cost of Living (Tenant Protection) (Scotland) Act 2022 came into force in October 2022 and introduced extra protections for tenants.
The Act temporarily:
restricts landlords from increasing the amount of rent they can charge private and social tenants, as well as for student accommodation .
places certain restrictions on enforcement of evictions from residential tenancies.
balances these restrictions with safeguards for those landlords who may be facing particular cost pressures or financial hardship.
The Scottish Parliament has approved some important changes to the Act. From 1 April 2023:
The rent cap for private and social tenants, as well as for student accommodation tenancies, has increased from 0% to 3%.
The restrictions on the enforcement of eviction orders remains in place.
Landlords who may be facing particular cost pressures or financial hardship can apply for approval to increase rent from 3% to 6%.
